Abstract

Violence in education occurs due to a lack of love from teachers. Teachers
treat students as subjects. Violence can occur because teachers no longer have or
have very little affection for students, or in the past the teacher himself was treated
harshly.
The problems in this research are: 1). How to regulate criminal acts of
violence in the teaching and learning process based on current values of justice, 2).
What are the weaknesses in regulating criminal acts of violence in the teaching and
learning process based on current values of justice, 3). How to reconstruct
regulation of criminal acts of violence in the teaching and learning process based
on the value of justice.
The research method uses a constructivist paradigm, with a social legal
research approach method, and a descriptive research type. Types and sources of
data use secondary materials in the form of primary legal materials, secondary
legal materials and tertiary legal materials. Data collection methods use literature
and qualitative analysis methods.
The results of the research are: 1).Regulation of criminal acts of violence in
the teaching and learning process is not yet fair, that violence against children in
schools is any form of behavior of other people which causes physical and nonphysical
discomfort
to
students
or
educators,
2).Weaknesses
in
the
regulation
of

acts
Criminal
violence
in
the
teaching
and
learning
process
based
on
the
value
of

justice
currently
consists
of
aspects
of
legal
substance,
legal
structure
and
legal

culture.
The
weakness
of
the
substantive
aspect
is
that
regulations
that
support
legal

protection

for teachers as professional staff already exist, but according to the
author, the teaching profession, which is a noble profession (officium nobile), is
currently very vulnerable to being involved in legal problems, both criminal, civil
and even administrative law. The weakness of the legal structure aspect is the weak
synergy between law enforcement officials. The weakness of the legal culture aspect
is the weak participation of the community. Society still considers that criminal
sanctions are a means of retaliation for someone's evil actions without considering
other factors and the impact of these sanctions on the perpetrator or victim. 3).
Reconstruction of regulations for criminal acts of violence in the teaching and
learning process based on the value of justice consisting of reconstruction of values
and reconstruction of norms. value of justice. Reconstruction of regulatory norms
for criminal acts of violence in the teaching and learning process based on the value
of justice, including in Law Number 35 of 2014 concerning Amendments to Law
Number 23 of 2002 concerning Child Protection Article 3 and in Law Number 14
of 2005 concerning Teachers and Lecturers Article 7 Paragraph 1 letter h
