Abstract

In this research the formulation matter to be discussed in this study is about: 1 ) how is the implementation of trading the property of minors made is before making official land certificate ( ppat )? ; 2 ) how the obstacles making official land certificate ( ppat ) in implementing trading land owned by minors? ; 3 ) what the legal implementation of the trading the property of minors made is before making official land certificate ( ppat )?
The methodology used is to use the methodology juridical sociological , specifications descriptive analistis research , the data is the main primary data , the data his supporters are secondary data , the analysis of the data in a qualitative analysis to the theory authority and the legal certainty .
The research is 1 ) implementation trading the property of minors made is before making official land certificate ( ppat ) should be represented by his parents / his by attaching the local court on selling permission for land ownership child under the age of the chinese , while for the indigenous with under the statements made by the / parents , endorsed by heads and the camat; 2 ) obstacles making official land certificate ( ppat ) in implementing trading land owned by minors where ppat face various character clients who want to run the trading the land of belonging to a underage but client was not have the district court permission selling about the land of belonging to a underage , While to petition district court permission selling about the land rights belonging to child under age need the time which long enough , to pass through because several times the trial .3 ) law that due to the implementation of the purchase of the land rights belonging to minors made to official certificate maker land ( ppat ) fixed considered valid along made to ppat with represented by his parents / favor of the trustee and by attaching the determination of local court about selling permission over land rights belonging to child under the age of class tonghoa to , while for indigenous groups with a letter under the hands of the statement made by wali old man , and endorsed by the head of neighborhoods local .
