Abstract
Indonesian law enforcement which be holded by law enforcement institution who merged at integrated criminal justice system consists of Police, Prosecutor, Judge and Correctional Institution who running the rule together to uphold the justice. But some deviation sometimes happens at the law enforcement and broke the human rights as a God creature. So that reason, law gives a space for everybody who dealing the law to maintain their human rights with the “Pre Trial”.
This institution (Pre Trial) is an Institution which be created to protect the suspected from such a deviation from the upholder. But Pre Trial is far from the perfect, there are so many things need to be repaired to warrant the human right so this isn’t only law on the book but also can be such a good news for the suspected when they dealing the law at the council. This makes the writer choose this tittle, “Recontruction The Pretrial At The Investigation And Effort The Criminal Law Renewal”
Some problem which be examining is how the Pretrial applies at this moment so the writer knows the weaknesses of the Pretrial to make the renewal of pretrial so we can find the right system at the law enforcement who aims to give the certainty for everybody and give the justice between the community.
Pre Trial is such a things to save the right from the deviation which come from the instrument of justice who impose the law and make the law lose his power to give the justice.
The history of our country which has been colonized by Netherlands make our legislation dominated by Netherlands law. It is very conflict and different with our personality which embrased by discussion system, so we often find that the regulation happens such a blinders and it hold such what is written and move out of the justice system. This makes me interested in making a tittle about Pre Trial
