ABSTRACT

The thesis with the title "Criminal Sanctions Against Empty Giro Bilyet Issuers in the Central Java Regional Police Law" the background of the writing of this thesis is 1) What is the process of carrying out the investigation of the perpetrators of the Blank Giro Bilyet and the sanctions in the Central Java Regional Police? 2) What are the constraints and solutions in carrying out the investigation of the perpetrators of Blank Giro Bilyet issuers and sanctions in the Central Java Regional Police?
The research method used in this study uses descriptive analytical juridical research research, namely research conducted by examining library material (secondary data) or library legal research, then described in the analysis and discussion as well as the legal theory used in this research is law enforcement theory and the theory of justice.
The results of the study using this sociological juridical method conclude that: 1) In civil law, the issuance of empty bilyet giro can be said to be a failure of debt repayment and can be sued to court with a default (broken promise). Achievement in Article 1234 of the Civil Code is something that can be demanded for fulfillment. In criminal law the issuance of blank bilyet giro can be sued to court with cases of fraudulent elements regulated in Article 378 of the Criminal Code. 2) Constraints that need to be considered in an effort to minimize criminal acts against the empty bilyet giro issuer, namely: a. Internal Constraints: 1) Doubts about the object of the case handled. 2) Lack of understanding of investigators related to the object of the case being handled. 3) The difference between understanding the investigator regarding the object of the case being handled. 4) Requires longer handling time and more costs. 5) Compile case handling. 6) Limited police investigators. b. External Constraints 1) Complainants / Reporters do not explain in chronological detail in complaints and / or police reports. 2) Complainants / Reporters need time to complete the evidence needed by the investigator. 3) Compressed / Reported in general are people who are educated and know the legal loopholes to justify their actions. 4) Lack / lack of other witnesses who see, hear, and witness directly.
