Abstract

Utilization of e-commerce media in the world of commerce is very impact on the international community in general and the people of Indonesia in particular. For the people of Indonesia this is related to a very important legal issue. The importance of legal issues in the field of e-commerce is mainly in providing protection to the parties who make transactions through the Internet.This development arises because of the offer and acceptance of the community, one of which is in the application website at Sophie Paris (www.SophieParis. com). Regarding this electronic sale in general (lex generalis) is regulated in the Civil Code, specifically (lex specialis) electronic trading transaction is regulated in Law Number 19 Year 2016 About Information and Electronic Transaction. The problem in the discussion of this thesis is how the implementation of the sale and purchase of moving objects through the internet (e-commerce) according to Law No. 19 of 2016 on ITE, and what are the obstacles and solutions in the execution of buying and selling objects moving through the internet (e-commerce) according to Law No. 19 of 2016 on ITE. This research is done in Business Center Jesicca BudiCabang Pati in Sophie Paris and online trading application at www website. Sophie Paris.com .. The research was conducted by using empirical juridical approach method and the specific was done by descriptive analysis. Sources and types of data used are primary data and secondary data. Data collection techniques used literature studies and field studies, and the data obtained will be analyzed qualitatively. Based on the result of the research, it is found that in the execution of sale and purchase transaction in e-commerce this is done by the parties in doing agreement which includes distributor and agent called as seller, business actor or merchant and member referred as buyer, coustomer or buyer. In its implementation must follow Article 17 and Article 19 of the ITE Law which regulates the administration of electronic transactions and legal agreements by using electronic systems of business actors and buyers. The obstacles in e-commerce transactions are divided into two parts: the internal inhibitions of the parties, namely the internal barriers and external barriers where there are other parties or unexplained problems from both sides are called external barriers. efforts to avoid obstacles in the sale and purchase online.In the completion of the Electronic Contract can be completed in Article 18 of the Law on ITE and Article 20 of the Law on ITE.
