Abstract
Thesis entitled Enforcement of Immigration Rules in Preventing Illegal Immigrants Entry into Indonesia. The cause of migration is due to a push factor and pull factor. Based on the description in this Thesis, the issues that will be in detail are: 1). How is the enforcement of immigration regulations in preventing the entry of illegal immigrants to Indonesia? 2). What are the constraints faced in enforcing immigration regulations in preventing the entry of illegal immigrants into Indonesia and how is the solution? The purpose of this study: 1). To analyze the enforcement of immigration regulations in preventing the entry of illegal immigrants to Indonesia. 2). To analyze the constraints faced in enforcing immigration regulations in preventing the entry of illegal immigrants to Indonesia and how the solution. Research method in this research use descriptive qualitative research type with sociological juridical approach. While the method of collecting data by using secondary data from literature study. The results of this study conclude that: 1) Implementation of law enforcement against illegal immigrants has not been regulated specifically in the Indonesian legal system but still only refers to UU.NO.6 Year 2011 on Immigration, namely Article 113. 2) The absence of time limits on how long immigrants should be allowed in Indonesia, the absence of budgets to repatriate immigrants, the absence of immigrant living expenses, the absence of immigrant immunity to return to their home countries, the absence of special rules to regulate illegal immigrants as enforcers law so it is difficult to implement.Cooperation undertaken by Indonesia with Australia on in fact it only provides unilateral benefits for Australia. In fact, Indonesia has difficulty in allocating funds to take care of immigrants. Keywords: Criminal Law Policy, Illegal Immigrant
