Abstract
ABSTRACT The economic condition of the family is very apprehensive to make one of the family that is a wife decided to become Women Workers abroad. Wife became Labor Women abroad originally approved by husband and family, but the couple can not maintain their marriage and ultimately marriage to divorce, because the distance between husband and wife far apart and not fulfill the needs so that the husband looking for someone else to change his wife's position. Background that has been in the hence the authors lift the title of study Legal Review About Divorced Women Laborers Divorce in Kendal Religious Court (Case Study Decision Number 2141 / Pdt.G / 2016 / PA.Kdl in Kendal Religious Court). This research raises the question of how the judges' judgment in deciding the case of Divorce Divorce of Women's Labor in Kendal Religious Court and what factors are causing the Divorce Divorce of Women Workers in Kendal Religious Court. This research uses normative juridical approach method with descriptive analytical research specification. This study was conducted by reviewing Law no. 1 Year 1974 About Marriage and Compilation of Islamic Law. With the data source is derived from the primary data and secondary data, and data analysis used is descriptive qualitative with data collection techniques using interviews and document studies. This study conducted interviews in the Kendal Religious Court. Based on the decision of Kendal Religious Court Number 2141 / Pdt.G / 2016 / PA.Kdl. The judge gave Due to the pledge of ba`in sughra (Nadhoni bin Na'im) against the plaintiff (Ayu Sulistiyowati binti Sutikno) and charged the plaintiff to pay the case fee which up to now is set at Rp. 651.000 Divorce divorce by TKW in Kendal Religious Court occurred due to economic problem factor where the money of plaintiff's work in Singapore sent by defendant with Total Rp. 16,000,000, - only exhausted to pay the defendant's debts in his workplace. Factors of third party / cheating. Factor lack of responsibility from husband. The continuous dispute factor that is the culminating crisis that occurs between husband and wife in such a way, sahinggga between the wife occurs conflict of opinion and quarrel, into two parties that can not be reunited and the two sides can not overcome it.
