Abstract
Research on "The Role and Responsibilities of the Investigator in Handling Children Actors Crime (A Case Study in Police Pemalang)" aims to analyze the role and responsibilities of the investigator in the handling of a child offender in the jurisdiction of Police Pemalang, barriers faced by investigators in the treatment of child offenders criminal offense in the jurisdiction of Police Pemalang and how to overcome them. The approach used is the juridical sociological. The collection of data through observation, interviews, document studies and literature study. Roles and responsibilities of the investigator in the handling of child offender in any jurisdiction in Pemalang district police of carrying out the mandate of Act No. 11 of 2012 on the Criminal Justice System Child by promoting the best interests of the child. In case there are problems that threaten the future of children is not contrary to the legislation investigator can conduct breakthrough with discretionary authority as the responsibility imposed upon him by the state considering legal aspects of expediency. Barriers Faced by Investigators in Handling Children Actors Crime Jurisdiction Police Pemalang that is the difference of opinion among law enforcement agencies regarding the terms of diversion referred to in Article 7 paragraph (2) letter a of Law No. 11 of 2012 on the Criminal Justice System Child, the short term of detention of children, child detention facility limitations, difficulty in presenting the parents of children in child domiciled in other jurisdictions or street children. How to overcome obstacles facing investigators in Handling Children Actors Crime Jurisdiction Police Pemalang among other efforts have been made following that coordination between law enforcement, accelerate the process of investigation of children, seeks not commit against children and the investigation process the child is done with the assistance Advisory or Supervising law and Society It needs a shared vision between law enforcement agencies in the handling of child offender. It required legislation that gives legal certainty regarding the juvenile justice system to do with the terms of diversion. Breakthrough law made Pemalang Police investigators in handling criminal child can be taken into consideration and input in the development of the law, especially those relating to Criminal Justice System Child. Handling of child perpetrators of criminal acts, investigators not to hesitate in making a legal breakthrough when he found the case that there is no rule by promoting the best interests of both children as mandated by Law No. 11 Year 2012 on Child Criminal Justice System.
