Abstract

”IMPLEMENTATION OFTHEMANAGEMENTDONATIONS of LANDPRODUCTIVEPEOPLEINEFFORTS TOIMPROVEWELFAREINSALATIGA DISTRICT”. Thesis : Postrgaduate Program of Sultan Agung University of Semarang Background: the waqf has a great role in the economic empowerment of the people but so far larger endowments objects destined for a place of worship so that less productive This research aimed to know : 1) the rules of waqf land for productive activities, viewed from the Shari’a and the applicable legislation, 2) to know how big contribution of private land endowments as the economic potential of the people in Salatiga district. To find the cause of private property is not much to contribute by Muslimd in Salatiga district. This research included non-doctrinal legal research (sociological), which is a descriptive qualitative. The research data though interviews and literature studies. Data type that is primery ( respondent) and secondary data. Analysis using the theory of interpretation. Results showed that : 1) in the Shari’a, the land given to the waqf property is a matter of ijtihad, there is no clear provision in the Qur’an and hadith. While the Government Regulation No. 28/1977 of the Waqf of land owned, 3rd Book of Presidential Instruction No.1/1991 of the Compilation of Islamic Law, which governs the Waqf and shadaqah, Law No.41/2004 of the Waqf, and the Government Regulation No. 42/2006 of the implementation of the Law No. 41/2004, is in according to Shari’a, 2) privately owned land handed over to Waqf has great potential to improve people’s economy, but its implementation is still a little big so that potential can not be perceived as a maimum, 3) privately owned land handed over to Waqf, which is used for productive activities is not much done in Salatiga district because : a) Structure of the law. Head Office of Religious Affairs has not been perfoming its duties as a supervisor, supervisors, and implementers about Waqf maximally, espencially in coashing, b) Has not been established yet the Waqf foundation in the level of Salatiga regency, c) Legal culture of Muslim in Salatiga are still oriented in the conventional mindset. Waqf is understood as a classic in the religious sense. Besides lack of socialization maximal Waqf laws to the grass community Keyword: waqf land, productive, welfare
