Abstract

This research aims to examine the nazir waqf regulations in improving the economy of the people which are not yet based on religious values of justice, find the weaknesses of the nazir waqf regulations in improving the economy of the people today, and find out how the nazir waqf regulations are constructed in order to improve the economy of the people based on the values of justice. religious The research method used is a normative legal research method aimed at examining the function of a norm which places the law as an instrument that regulates and controls society. The approaches used in this research are the conceptual approach, statutory approach, philosophical approach and comparative approach. The analysis used is descriptive qualitative, The results of the research show that Nazir waqf regulations in improving the people's economy are not based on religious justice values. Based on the facts, it can be said that the potential of waqf as a means of doing good for the benefit of society has not yet been managed and utilized optimally in a national scope. Until now there is still an unfavorable impression regarding waqf because waqf is better understood as immovable property. As a result, the interpretation emerged that in order to maintain the eternity of waqf assets, they must not be bought and sold. In fact, if waqf assets can be managed well, then waqf assets can become productive assets that produce profits that can be used to improve the economy of the people. For this reason, regulations regarding Nazhir Waqf (as waqf managers) have a very important role in improving the people's economy towards a more equitable and religiously based economy because it originates from religious activities in the form of waqf. Weaknesses in the Nazir Waqf staff regulations in Law Number 41 of 2004 concerning Waqf are that the potential for waqf has not been properly managed and managed based on the principle of professionalism, thus having a big impact on people's lives. The nation's social burden, in the form of an economic crisis, will be solved fundamentally and comprehensively through a system of collecting, managing and utilizing waqf assets within a national scope. The ideal reconstruction of the nazir waqf regulations in Law Number 41 of 2004 concerning Waqf in the context of improving the economy of the people based on religious justice values in Indonesia really needs to be carried out in an integrated manner with regard to the articles concerning Nazir Waqf, cash waqf and the Indonesian Waqf Board.
